Lakeland trustees voted late last month on an item that was not listed on the school board meeting’s agenda — for the second time in the last three months.

During a July 29 meeting, billed as an executive session, trustees voted on an “Item E.” The item was not listed as an action item, and no details were posted.

Idaho Code § 74-204(4) requires an agenda to identify an item as an “action item” when it requires a vote, providing notice to the public that action may be taken.

Still, Vice Chair Ramona Grissom moved to approve the item the board “heard in executive session, as presented by the district and legal counsel,” according to a video of the meeting. The motion passed unanimously.

On Monday, EdNews asked district leaders about the action and filed a complaint with the Kootenai County Prosecutor’s Office, but has not received a response.

In June, Lakeland Trustees similarly voted to extend Interim Superintendent Jake Massey’s contract.

After EdNews filed a complaint with the Kootenai County prosecutor, trustees self-cured by holding a noticed vote on July 17.

Lakeland is one of a handful of school districts that are not part of the Idaho School Boards Association, which provides legal support and training to trustees.

Trustees in Lakeland also meet more frequently, often in executive session, than a typical school board. The board has met 37 times so far this year, including 26 executive sessions. Potential action items were listed regarding six of those 26 executive sessions.
