Lakeland School District trustees voted publicly on Wednesday to extend the contract of interim superintendent Jake Massey, a redo of action taken last month.

The board voted to approve the contract last month, but a vote on the contract did not appear on the meeting’s agenda, which is required by law. EdNews filed a complaint with the Kootenai county prosecutor to challenge the legality of taking action on the contract when that action was not on the public agenda. The prosecutor said last week he would investigate the complaint.

State law allows school districts to acknowledge and cure an open meeting violation to avoid civil penalties. While trustees did not address the possible violation on Wednesday, or if they were contacted by the prosecutor, they did discuss and vote on the interim superintendent’s contract.

Board Chair Michelle Thompson said that there was “some confusion” over the vote at the June 17 meeting.

“At the last board meeting, we had technical difficulties at the end that did not capture any motions,” Thompson said. “So for clarification purposes, the interim superintendent contract has been brought back for board action.” 

The board voted unanimously to approve the contract Wednesday.

The Kootenai County Prosecutor did not respond to request for comment on the vote.

Since March, Lakeland’s agendas have show no items up for action post executive session, according to an EdNews review of agendas.

Wednesday’s agenda showed four items that could require action from the board but details are light.

Other school boards list what action the board could take. For example, the nearby Coeur d’Alene School Board’s July 13 agenda listed “Due Process Hearing Authorization for Employee A” as a possible post-executive session action item.

Lakeland’s trustees have met 31 times so far in 2026, including 25 executive sessions. Potential action items were listed at six of those 25 executive sessions.
