An Ada County judge could soon approve a $999,999 settlement against the Boise School District.
The settlement would close one of seven cases involving Gavin Snow, a former special education assistant at two Boise elementary schools. Snow died by suicide in January, taking his life as Boise police attempted to arrest him on child sexual abuse charges.
Two parents sued the Boise district in June, saying Snow “sexually abused and photographed” their son on several occasions while he attended Valley View Elementary School. The parents later pulled their son from Boise schools.
During a brief court hearing Tuesday, the boy’s father said his son is doing better, “but he’s got problems.”
In a tort claim in March, the parents alleged damages of more than $1 million. The proposed $999,999 settlement would go into a trust, and the parents would use money from the settlement to seek out counseling and medical care for their son, said Matthew Gunn, the parents’ attorney.
At the conclusion of the hearing, District Judge Jason Scott said he could see no reason why he wouldn’t be able to approve the settlement.
The state and the Department of Health and Welfare have no objection to the proposed settlement, lead deputy attorney general Jeremy Younggren said in a court filing Monday. The Boise district did not have an attorney present for Tuesday’s hearing.
But in November, the district announced that it had reached $7 million in settlements to close the lawsuit and six tort claims involving Snow. At the time, the district said one of the payments totaled $2.8 million, with the remaining settlements awaiting court approval.
It’s unclear how many of the cases are settled, or whether the district has received additional complaints involving Snow. As of Wednesday afternoon, the district has not provided additional information to Idaho EdNews on settlements or tort claims.
The district’s insurance carrier will cover $2 million of the district’s payments. The district says it will cover much of the balance internally, by putting less money into a fund for facilities and maintenance projects.
